Agreement to Terms

By accessing or using MakeMyKankotri ("Platform," "Service," "we," "us," or "our"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use our Platform.

These Terms apply to all users, including visitors, registered users, and paying customers.

Description of Services

MakeMyKankotri provides a digital platform for creating and sharing animated invitation cards with personalized voice greetings for:

• Wedding ceremonies and celebrations
• Baby showers (Godh Bharai)
• Engagement parties
• Birthday celebrations
• Other special events

Core Features:

• Animated invitation templates with smooth, professional animations
• Personalized voice greeting generation
• Guest management system
• RSVP tracking and analytics
• Multi-language support (English, Hindi, Gujarati)
• WhatsApp and social media sharing
• Mobile-responsive invitation pages

User Accounts

Registration

• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You must be at least 18 years old to create an account
• One person may not create multiple accounts
• You are responsible for all activities that occur under your account

Account Security

• Use a strong, unique password
• Do not share your password with others
• Notify us immediately of any unauthorized access to your account
• We are not liable for losses caused by unauthorized use of your account

Account Termination

You may delete your account at any time through your account settings. We reserve the right to suspend or terminate accounts that:

• Violate these Terms
• Engage in fraudulent or illegal activities
• Abuse or misuse the Platform
• Remain inactive for extended periods (with prior notice)

Pricing and Payments

Pricing Model

Simple Pay-Per-Invitation Model:

• Each template has a fixed price (all inclusive)
• Pay once each time you create an invitation from a paid template
• All features included (voice greetings, animations, RSVP tracking)

Example: Creating your first invitation from "Wedding Premium" template (₹299) requires payment. Creating a second invitation from the same template requires another ₹299 payment.

What's Included in the Price

Every paid template purchase includes:

• Full invitation customization
• Voice greetings
• RSVP tracking and analytics
• WhatsApp and social media sharing
• Mobile-responsive pages
• All animations and features

Payment Processing

• Payments are processed securely through industry-standard payment gateways
• All prices are final (no additional taxes apply)
• Payment confirmation will be sent via email
• Your invitation is created immediately after successful payment

Refund Policy

• No Refunds: All purchases are final and non-refundable once payment is completed and your invitation is created
• Exceptions: Refunds may be considered in cases of:
  • Technical errors preventing invitation creation
  • Duplicate charges
  • Service unavailability due to platform technical failure
• Refund Requests: Must be submitted within 7 days of purchase via contact@makemykankotri.com

User Content and Responsibilities

Your Content

You retain ownership of all content you create on MakeMyKankotri, including:

• Invitation text and descriptions
• Guest information
• Voice message templates
• Uploaded images and media

By using our Platform, you grant us a limited license to:

• Store, process, and display your content
• Generate voice audio from your text
• Deliver your invitations to guests via public URLs
• Use anonymized data for analytics and improvements

Content Guidelines

You agree NOT to create or share content that:

• Violates laws or regulations
• Infringes on intellectual property rights
• Contains hate speech, harassment, or discrimination
• Promotes violence or illegal activities
• Contains explicit, pornographic, or inappropriate material
• Spreads misinformation or spam
• Impersonates others or misrepresents identity

Guest Information

You are responsible for:

• Obtaining consent from guests before adding their information
• Ensuring accuracy of guest details (names, phone numbers)
• Complying with data protection laws (GDPR, privacy regulations)
• Not using the Platform for unsolicited commercial messages (spam)

Media Rights

You represent and warrant that:

• You own or have rights to all images and media you upload
• Your content does not infringe on third-party copyrights, trademarks, or rights
• You have obtained necessary permissions for any photos of individuals

Intellectual Property Rights

Platform Ownership

MakeMyKankotri and all its features, designs, templates, code, and trademarks are owned by us and protected by copyright, trademark, and other intellectual property laws.

Brand and Trademark

• "MakeMyKankotri" is a proprietary brand
• Use of our name, logo, or trademarks requires prior written consent

Template Usage

• Templates are provided for personal, non-commercial use
• You may not resell, redistribute, or repackage templates
• Templates may not be used to create competing services

Attribution

• Links to MakeMyKankotri in invitation footers must remain intact

Service Usage and Limitations

Acceptable Use

You agree to use MakeMyKankotri for legitimate invitation purposes only. Prohibited activities include:

• Using the Platform for spam, phishing, or fraudulent activities
• Attempting to access unauthorized areas or data
• Reverse-engineering, decompiling, or extracting source code
• Overloading servers or interfering with Platform operations
• Creating automated bots or scrapers (rate limiting enforced)
• Reselling or commercializing access to the Platform

Service Limitations

• Guest Management: Subject to platform policies
• Voice Generation: Subject to availability of our voice generation service
• Storage: Media and voice files stored on secure cloud infrastructure
• Uptime: We aim for 99.9% uptime but do not guarantee uninterrupted service
• Feature Changes: We may add, modify, or remove features with or without notice

Third-Party Services

Our Platform integrates with trusted third-party service providers for:

• Payment processing
• Media and file storage
• Voice generation technology
• Application hosting and delivery

Use of these services is subject to their respective terms and policies.

Voice Generation

Technology

• We use text-to-speech technology for voice generation
• Supports multiple languages including Gujarati, Hindi, and English
• Professional voice options available for your invitations

Voice Content

• You are responsible for the text content of voice messages
• Voice content must comply with our Content Guidelines
• Generated audio is based solely on the text you provide

No Guarantees

• Voice quality depends on text input and language complexity
• We do not guarantee specific pronunciation or accent accuracy
• Voice generation requires our infrastructure to be online
• Audio playback depends on guest devices and internet connectivity

Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains:

• How we use and protect your information
• Your rights regarding your data
• Third-party service providers

By using MakeMyKankotri, you also agree to our Privacy Policy.

Disclaimers and Limitations of Liability

Service "As-Is"

MakeMyKankotri is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including:

• Merchantability or fitness for a particular purpose
• Uninterrupted, timely, secure, or error-free service
• Accuracy or reliability of content or voice generation
• Compatibility with all devices or browsers

No Liability for Third-Party Services

We are not responsible for:

• Failures or issues with third-party service providers
• Guest devices' inability to view invitations or play audio
• Social media platforms' handling of shared links
• Internet connectivity or network issues

Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid us in the past 12 months
• We are not liable for data loss if you fail to maintain backups
• We are not liable for issues caused by user error or misuse

Force Majeure

We are not liable for delays or failures due to circumstances beyond our control, including:

• Natural disasters, pandemics, or acts of God
• Government actions, wars, or civil unrest
• Internet outages or infrastructure failures
• Cyberattacks or security breaches beyond reasonable prevention

Indemnification

You agree to indemnify and hold harmless MakeMyKankotri, its owners, employees, and partners from:

• Any claims arising from your use of the Platform
• Your violation of these Terms or applicable laws
• Your content or guest data that infringes on third-party rights
• Unauthorized access to your account due to your negligence

Dispute Resolution

Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles.

Informal Resolution

Before initiating formal proceedings, please contact us at contact@makemykankotri.com to resolve disputes informally.

Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with Indian arbitration laws, conducted in Surat, Gujarat.

Class Action Waiver

You agree to resolve disputes individually, not as part of a class action or collective proceeding.

Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon:

• Posting the updated Terms on this page
• Updating the "Last Updated" date

Your continued use of MakeMyKankotri after changes constitutes acceptance of the updated Terms.

Termination

We may suspend or terminate your access to the Platform immediately, without notice, for:

• Violation of these Terms
• Fraudulent or illegal activities
• Abuse, harassment, or inappropriate conduct
• Non-payment for services
• Security concerns or threats

Upon termination:

• Your access to the Platform will be revoked
• Active invitations may remain accessible to guests for a grace period
• We may delete your account data after 30 days
• You remain liable for any outstanding payments

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MakeMyKankotri.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full effect.

No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer your rights under these Terms. We may assign our rights to any successor or affiliate.
